RARECRUISE TERMS & CONDITIONS

These Terms & Conditions apply to all cruise packages and travel arrangements booked through RareCruise, a brand operated by Rarecation Travel Sdn. Bhd. (the “Agency”).

By making a booking, payment, or confirmation, the Customer acknowledges that they have read, understood, and agreed to be bound by these Terms & Conditions.

 

1. Agency Status and Relationship

1.1 Rarecation Travel acts solely as an authorised sales representative and intermediary for cruise lines, airlines, hotels, transportation providers, and other travel service providers.

1.2 The contract of carriage for the cruise voyage (the “Passage Contract”) is strictly between the Customer and the Cruise Line.

1.3 Rarecation Travel is not a carrier and does not own, operate, manage, or control any cruise vessel, airline, hotel, ground transportation service, or other supplier services.

1.4 Rarecation Travel shall not be responsible or liable for the acts, omissions, delays, operational decisions, insolvency, bankruptcy, or service failures of any cruise line, airline, hotel, transportation provider, or other third-party supplier.

 

2. Incorporation of Third-Party Supplier Terms

2.1 By confirming a booking with RareCruise, the Customer agrees to be bound by the terms and conditions of all third-party suppliers involved in the travel arrangements.

2.2 These suppliers may include, but are not limited to:

a) cruise lines
b) airlines
c) hotels
d) ground transportation providers
e) tour operators
f) port authorities or local operators

2.3 Supplier terms govern matters including:

a) cruise itinerary changes
b) flight schedules
c) safety regulations
d) boarding procedures
e) baggage rules
f) cancellations or delays
g) passenger conduct

2.4 In the event of any conflict between supplier terms and these Agency Terms, the supplier terms shall prevail for matters relating to the supplier’s services.

 

3. Booking Confirmation and Payments

3.1 A booking is confirmed only upon receipt of the required deposit or full payment.

3.2 Until payment is received, all reservations, pricing, and availability remain subject to change without prior notice.

3.3 RareCruise reserves the right to cancel or release reservations if payment is not received within the specified deadline.

3.4 Certain promotional fares or supplier offers may require immediate full payment and may be non-refundable or non-changeable.

3.5 All administrative, service, consultation, handling, or processing fees charged by RareCruise are strictly non-refundable once a booking has been confirmed.

3.6 Payments toward cruise fares, airline tickets, and other supplier services remain subject to the refund, cancellation, and amendment policies of the respective suppliers.

 

4. Payment Fraud and Chargeback Protection

4.1 By making payment, the Customer confirms that they are the authorised cardholder or have obtained proper authorisation from the cardholder.

4.2 If a Customer has concerns regarding a charge or booking, the Customer agrees to contact RareCruise first to seek resolution before initiating a chargeback or payment dispute.

4.3 RareCruise reserves the right to provide booking records, communications, invoices, and supplier terms to financial institutions during dispute investigations.

4.4 Where a dispute is determined to be fraudulent, abusive, or inconsistent with these Terms, RareCruise reserves the right to recover reasonable administrative, banking, investigation, or legal costs.

 

5. Pricing and Currency Adjustments

5.1 RareCruise reserves the right to adjust package prices due to circumstances beyond its reasonable control.

5.2 These circumstances may include:

a) cruise fare adjustments
b) airline fare changes
c) government taxes or port charges
d) fuel surcharges
e) currency exchange fluctuations
f) supplier price adjustments

5.3 If such increases are imposed after booking confirmation, RareCruise reserves the right to revise the total package price accordingly.

 

6. Pricing Errors and Corrections

6.1 RareCruise reserves the right to correct any typographical, system, pricing, or calculation errors appearing in quotations, promotional materials, invoices, or booking confirmations.

6.2 In the event of such an error, RareCruise will notify the Customer and provide the option to:

a) proceed with the corrected price; or
b) cancel the booking and receive a refund of payments made to RareCruise.

 

7. Changes or Cancellation by Customer

7.1 Any request to amend or cancel a booking must be submitted in writing.

7.2 Amendments are subject to availability and supplier approval.

7.3 Amendment fees, fare differences, and supplier penalties may apply.

7.4 Cancellation charges will be determined in accordance with supplier policies.

7.5 The following are non-refundable once booking is confirmed:

a) RareCruise service fees
b) supplier deposits
c) promotional fares
d) non-refundable airline tickets or cruise fares
e) payment gateway or transaction fees

7.6 Failure to appear for travel (“No Show”) shall be treated as cancellation with full forfeiture of payment.

7.7 No refund will be provided for unused services after travel has commenced.

 

8. Changes or Cancellation by Suppliers

8.1 Cruise lines, airlines, and other suppliers may modify travel arrangements including:

a) itinerary changes
b) port substitutions
c) sailing schedule adjustments
d) flight schedule changes
e) vessel or aircraft replacement
f) cancellation of sailings or flights

8.2 RareCruise shall not be responsible for such operational decisions made by suppliers.

8.3 Any compensation or refund will be subject solely to the supplier’s policies.

 

9. Flight Scheduling and Missed Embarkation

9.1 Where flights are arranged as part of a full package, RareCruise will plan flight schedules with reasonable time for cruise embarkation.

9.2 By confirming the booking, the Customer agrees to the proposed flight arrangements.

9.3 RareCruise shall not be responsible for missed cruise departures due to:

a) flight delays
b) missed flight connections
c) immigration delays
d) transportation disruptions
e) late arrival at the port

9.4 RareCruise may assist in coordinating alternative arrangements where possible, but all additional costs shall be borne by the Customer.

 

10. Customer Responsibility for Information Accuracy

10.1 Customers are responsible for ensuring that all personal information provided during booking is accurate.

10.2 This includes:

a) passenger names
b) passport details
c) travel dates
d) contact information

10.3 Passenger names for airline or cruise bookings must exactly match the name shown in the passport.

10.4 RareCruise shall not be responsible for costs or penalties arising from incorrect or incomplete information provided by the Customer.

 

11. Travel Documentation and Visas

11.1 Customers are responsible for ensuring they possess valid travel documents including passports with at least six months validity.

11.2 Additional documentation may include visas, transit permits, vaccination certificates, or entry permits.

11.3 RareCruise shall not be responsible if a passenger is denied boarding or entry due to documentation issues.

11.4 Customers shall bear all resulting costs including accommodation, transportation, repatriation, fines, or penalties.

 

12. Prohibited Items and Passenger Conduct

12.1 Passengers must comply with all rules imposed by cruise lines, airlines, port authorities, and local authorities.

12.2 Dangerous items including weapons, explosives, illegal substances, and hazardous materials are prohibited.

12.3 Passengers must behave responsibly and respectfully throughout the journey.

12.4 Cruise lines or airlines may refuse boarding or remove passengers for unsafe or disruptive behaviour.

12.5 RareCruise reserves the right to refuse bookings or terminate travel arrangements where passenger behaviour poses a safety risk.

 

13. Health and Fitness to Travel

13.1 Passengers must ensure they are medically fit to travel.

13.2 Passengers must inform RareCruise in writing of any medical conditions, disabilities, mobility limitations, or pregnancy.

13.3 Cruise lines and airlines may require medical clearance prior to travel.

13.4 Passengers denied boarding due to medical reasons shall bear all resulting costs.

 

14. Travel Insurance

14.1 RareCruise does not provide travel insurance unless explicitly stated.

14.2 Customers are strongly advised to obtain comprehensive travel insurance covering:

a) trip cancellation
b) travel delays
c) medical treatment
d) evacuation and repatriation
e) baggage loss

14.3 Customers acknowledge that failure to obtain insurance may result in unrecoverable financial losses.

 

15. Force Majeure

15.1 RareCruise shall not be liable for failure or delay caused by circumstances beyond its control including acts of God.

15.2 Such events may include:

a) war or armed conflict
b) terrorism
c) pandemics
d) natural disasters
e) government restrictions
f) political unrest
g) flight disruptions

15.3 Travel arrangements may be cancelled, postponed, or modified due to such events.

 

16. Limitation of Liability

16.1 RareCruise acts solely as an intermediary agent arranging services provided by independent suppliers.

16.2 RareCruise shall not be liable for injury, loss, delay, inconvenience, or damages caused by suppliers, weather, government actions, or operational disruptions.

16.3 Passengers participate in travel at their own risk.

16.4 RareCruise shall not be responsible for indirect or consequential damages including loss of enjoyment or vacation time.

16.5 The total liability of RareCruise shall not exceed the service fees received for the booking.

 

17. Data Protection

17.1 Rarecation Travel may collect and process personal data necessary to arrange travel services.

17.2 This may include passport information, contact details, travel preferences, dietary requirements, or limited health information.

17.3 Such data may be shared with suppliers, insurers, or authorities where required.

 

18. Complaints and Dispute Resolution

18.1 Customers must submit complaints through RareCruise official communication channels.

18.2 Complaints should be submitted within thirty (30) days after completion of travel.

18.3 RareCruise will review and respond within a reasonable timeframe.

18.4 Customers must not publish false or defamatory statements intended to damage the reputation of RareCruise.

 

19. Photography, Video and Marketing Use

19.1 RareCruise or its representatives may capture photographs or videos during travel.

19.2 Such materials may be used for promotional or marketing purposes.

19.3 Customers who do not wish their image to be used must notify RareCruise in writing before travel.

19.4 No compensation shall be payable for the use of such materials.

 

20. Entire Agreement and Severability

20.1 These Terms constitute the entire agreement between the Customer and Rarecation Travel.

20.2 If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force.

 

21. Acceptance of Terms

21.1 By making a booking, confirming a reservation, or making payment, the Customer confirms acceptance of these Terms & Conditions.

21.2 The person making the booking is deemed authorised to act on behalf of all passengers included in the booking.

21.3 RareCruise reserves the right to amend these Terms where necessary.
